JUSTICE SANJAY PRIYA ORAL ORDER 03-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sheikhpura P.S. Case No. 172 of 2010 instituted for the offence under Sections 302, 201/34 and 379 of the Indian Penal Code.

In the written report it is alleged that deceased Subodh Kumar @ Tesu was seen by witnesses on 28.5.2010 at 4:00 p.m. taking alcohol with petitioner and four other accused persons in Anand Dhaba, near Hatia More, Barbigha. As such, this is a case of last seen.

Counsel for the petitioner submits that informant is not an eye witness of the case. The police after investigation did not submit charge sheet against the petitioner, but cognizance has been taken against the petitioner by learned Magistrate. Counsel for the petitioner further submits that co-

Petitioner is said to be in custody since 28.9.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura P.S.
