Petitioner seeks bail in Excise Case No.829 of 2018 arising out of Durgawati P.S. Case No.315 of 2018 instituted for the offence under Section(s) 30(a), 38, 41 of Bihar Prohibition and Excise Act, 2016.

It is alleged that 60 bottles of foreign liquor each of 350 ML and 5 bottles foreign liquor each of 750 ML have been recovered from possession of the petitioner.

Counsel for the petitioner submits that Petitioner is in custody since 18.09.2018 having clean antecedents. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner,

Patna High Court Cr.Misc. No.69360 of 2018(2) dt.30-11-2018 2/2 above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Kaimur at Bhabua, in connection with Excise Case No.829 of 2018 arising out of Durgawati P.S. Case No.315 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
