The petitioner has filed the instant application for grant of regular bail in a case registered under sections 302/34 of the Indian Penal Code and section 27 of the Arms Act. As per allegation in the F.I.R., the informant's son who had gone to sleep at the house of his friend was shot and died. Informant states that he is convinced that the accused persons including the petitioner herein with whom there was land dispute, have a hand in his killing.
It is submitted by learned counsel for the petitioner that there is no eye witness to the occurrence. The alleged suspicion raised by the informant is unfounded and baseless. The case of the petitioner stands on a similar footing to that of
Patna High Court CR. MISC. No.9910 of 2021(3) dt.29-07-2021 2/2 coaccused Arjun Singh who has been enlarged on bail vide order dated 7.7.2021 passed in Cr.Misc. no.17211 of 2021. The petitioner is in custody since 2.10.2020.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the petitioner being in custody for more than 9 months and grant of bail to coaccused, this Court directs the petitioner to be enlarged on bail in connection with Buxar Mufassil P.S. Case no. 314 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar.
