JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 457 and 380/34 of the Indian Penal Code.

The petitioner is said to have been caught in the house of informant when he along with others entered into the house to commit theft and it is said that the associate of the petitioner fled with stolen goods.

Submission on behalf of the petitioner is that there was land dispute between the petitioner and informant as both are neighbours and, as a matter of fact, prior to institution of this case, one S.H.O., Pusa P.S. had given a petition before the concerned

Patna High Court Cr.Misc. No.25624 of 2016 (2) dt.21-06-2016 authority for measurement of their lands and due to aforesaid measurement, the informant was also going to be affected and that was the reason, he has implicated the petitioner in the present case. It is further submitted that the petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sankash Chandra, Judicial Magistrate 1st Class, Samastipur in connection with Pusa P.S.
