Petitioner, who is in custody, seeks bail in connection with Sessions Trial No. 317 of 2018/CIS No. 317 of 2018 arising out of Tikapatti P.S. Case No. 88 of 2017 registered for the offences punishable under Sections 302, 324, 201, 120(B) and 34 of the Indian Penal Code.

Informant who is son of deceased has stated in his written complaint that on 16.06.2017 it was a day of nomination and there was some dispute between his father and co-accused Tuno Mandal and he threatened to kill the father of the informant and thereafter took away father from a room and was found murdered and has named 16 persons in the F.I.R. It has been submitted that petitioner is innocent and

Patna High Court Cr.Misc. No.69512 of 2018(2) dt.04-12-2018 2/2 ha been committed no offence. Petitioner is not named in F.I.R., his name has surfaced in this case on the basis of representation filed by Sarpanch namely, Sheela Devi before the Superintendent of Police, Purnea, alleging illicit relation between the mother of the petitioner and the deceased. Petitioner has no criminal antecedent and is in custody since 23.04.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Purnea, in connection with Sessions Trial No. 317 of 2018/CIS No. 317 of 2018, arising out of Tikapatti P.S. Case No. 88 of 2017.
