JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 386, 353, 120B, 419, 420, 417, 468, 471 of the Indian Penal Code, Section 17 of C.L.A. Act and Sections 38, 39, 40 of U.A.P. Act.
The present case has been lodged on the basis of self statement of Officer in Charge of Rafiganj police station, who claimed that on the basis of confidential information he as well as other police officials kept watch on the activities of the petitioner and then it was detected that petitioner had links with extremist groups and petitioner used to help them by providing posters and important information. Subsequently, petitioner was caught by the
Patna High Court Cr.Misc. No.30054 of 2016 (3) dt.18-08-2016 2/2 police and only mobile phone was recovered from conscious possession of the petitioner.
Submission on behalf of the petitioner is that petitioner does not have any criminal antecedent and on mere suspicion he has been caught by the police.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 38 of 2016.
