Petitioner is in custody since 19.6.2019 in a case registered for the offence under sections 304B/34 of the Indian Penal Code.

Petitioner is the husband of the deceased and there is allegation against him that he and his family members subjected the victim to the cruelty and they finally killed her by hanging on account of non-fulfilment of dowry demand. Learned counsel for the petitioner submits that the petitioner has not killed his wife by strangulation, rather, on a tiff, she committed suicide.

State's counsel opposes the prayer for bail pointing out that the victim died at her in-laws house within seven years of marriage and the post mortem report shows that the victim

Patna High Court CR. MISC. No.49354 of 2019(3) dt.06-11-2019 2/2 died of asphyxia and there was ligature mark around her neck which support the allegation against the petitioner. In view of nature of the allegation against the petitioner, his prayer for bail is rejected.
