JUSTICE RAMESH KUMAR DATTA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioner and learned counsels for the State and for the Accountant General, Bihar. The petitioner seeks payment of the death-cum-retiral dues of her late husband, Kamal Deo Singh, who died in harness on 30.7.1990 as Sub Inspector of Police.

According to the counter affidavit filed on behalf of the Department, all the death-cum-retiral dues of the deceased employee have already been paid to the petitioner. Learned counsel for the petitioner raises a grievance that although the Pension Payment Order was issued but the same does not give the benefit of pay revision as per the Government Circulars from 1996.

No details are to be found in the writ petition as to what is the amount received by the petitioner and how the said amount is not in accord with the different Resolutions and Circulars in that

Patna High Court CWJC No.11845 of 2015 (2) dt.22-10-2016 regard with respect to pay revision, etc. The PPO having been issued the revision of pay as per the acceptance of recommendations of the Pay Revision Commission by the State Government is automatic.

The writ application is, accordingly, dismissed. However, the petitioner on the basis of the facts, figures and calculations may approach the respondent authorities for any rectification in the PPO and the authorities may look into the said matter considering the fact that she is an old widow.
