2. The present writ petition has been filed for quashing the order dated 23.09.2014 passed by the North Bihar Regional Transport Authority, Muzaffarpur (Annexure-4).
3. At the very outset, learned counsel for the petitioner states that parallel remedy by way of appeal in T. A. No. 11/2015 has already been availed by challenging the aforesaid order dated 23.09.2014 and such appeal has been admitted for hearing by order dated 12.01.2017. Learned counsel for the petitioner further states that when the earlier writ petition had been filed, the State
Patna High Court CWJC No.4222 of 2017 dt.05-01-2018 2/2 Transport Appellate Tribunal, Bihar Patna was not functional at that time but however, the same has now resumed functioning.
4. In the above circumstances, this Court is not inclined to enter into the merits of the matter. The writ petition stands disposed of with liberty to the petitioner to pursue his appeal pending before the State Transport Appellate Tribunal, Bihar Patna in T.A. No. 11/15 which would be disposed of on its own merits and in accordance with law.
