The petitioner seeks regular bail in connection with Bhagwanpur P.S.Case no.107 of 2018 dated 23.6.2018 registered for offences punishable under Sections 341, 323, 324, 307/34 of the Indian Penal Code and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.
Allegation as per FIR is that the police on information that some persons have fired went to the place of occurrence and found that one person has been apprehended by the villagers i.e. the petitioner and he was handed over to the police and from his possession one country-made pistol and one cartridge were recovered.
Submission of the learned counsel for the petitioner is
Patna High Court Cr.Misc. No.73951 of 2018(2) dt.17-12-2018 2/2 that there is no eye witness of the occurrence and all the witnesses are hearsay witness and moreover he is in custody for about six months, having no criminal antecedent. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge III, Vaishali at Hajipur in connection with Bhagwanpur P.S.Case No.107 of 2018 dated 23.6.2018..
With the aforesaid observation, this application is allowed.
