Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Sarai Ranjan P.S. Case No. 63 of 2020, lodged under Sections 272 & 273 of Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per prosecution case, the total recovery of 12.600 liter of wine is the subject matter relating to the present case. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. She further submits that recovery is alleged to be made near the door of petitioner. She also submits that petitioner is in custody since

Patna High Court CR. MISC. No.53968 of 2022(2) dt.18-11-2022 2/2 17.08.2022, charge sheet has already been filed in this case and there are 5 criminal cases pending against him, in which he is on bail.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II-cumSpecial Judge, Excise Court No.2, Samastipur in connection with Sarai Ranjan P.S. Case No. 63 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
