The petitioner is apprehending arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant. In 164 Cr. P.C. statement the victim stated that she was taken by the petitioner to Howrah by misleading her on the pretext of illness of her mother, subsequently the victim was made to reach at Patna Railway station. In 164 Cr. P.C. statement the victim got her age recorded as 17 years when the court assessed her age as such.

It is submitted by learned counsel for the petitioner that the victim has stated that no misbehaviour was done by this

Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Nathnagar (Balmatia) P.S. Case No. 79 of 2015 pending in the court of learned CJM, Bhagalpur. Accordingly, the application is disposed of.
