03-12-2018 Heard Sri Nityanand Neeraj, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 11-08-2018 in Barahiya P.S. Case No. 143 of 2018 registered for offence under Section 414 of the Indian Penal Code, has prayed for grant of bail.
By way of referring to F.I.R., learned counsel for the petitioner submits that petitioner, without any knowledge of the fact that the motorcycle, which was with him, was stolen or not, he had purchased the same from one another person after payment of Rs. 6,000/- and petitioner was arrested since he failed to produce any document relating to motorcycle in question. Learned counsel for the petitioner has also drawn my attention to statement made in paragraph - 3 of the petition to
Patna High Court Cr.Misc. No.70690 of 2018(2) dt.03-12-2018 2/2 show that petitioner is having clean antecedent. In view of nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Raju Vishwakarma be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai in connection with Barahiya P.S.
