The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 354, 506, 379/34 of the Indian Penal Code. It is alleged that two persons assaulted the son of the informant, when informant went to rescue, she was also assaulted by the accused persons including the petitioners and snatched ornaments worth Rs.10,000/-, cash Rs. 2,000/- and clothes Rs. 20,000/- from the box kept in the house.
It is submitted by the learned counsel for the petitioners that for the petty dispute the accusation has been
Patna High Court Cr.Misc. No.36958 of 2015 (2) dt.14-09-2015 levelled. For the occurrence of 28.09.2014 the First Information Report was registered on 16.10.2014. Supplementary affidavit has been filed by the petitioners in which it has been stated in para- 2 that no injury has been received by the informant, his son and other persons which reads as follows:- "That no any injury was received either informant, or any other person including his son. That allegation against the petitioners are false and concocted."
Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. Considering the delayed lodging of the First Information Report and statement has been made in para-2 of the supplementary affidavit, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Madhepura in connection with Madhepura Mahila P.S. Case No. 32 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
