The petitioner seeks bail in Aurangabad (Town) P.S. Case No. 183 of 2018, registered for the offence punishable under Section 414 of the Indian Penal Code.

There are two accused persons named in the FIR with identical allegation.

Learned counsel for the petitioner contends that similarly circumstances co-accused Shiv Kumar Yadav, has been granted regular bail by this Court by orde dated 29.10.2018, passed in Cr. Misc No. 63979 of 2018. The submission advanced on behalf of the petitioner appears to be correct.

Considering the facts and circumstance of the case,

Patna High Court Cr.Misc. No.70267 of 2018(2) dt.04-12-2018 2/2 the application is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in Aurangabad (Town) P.S.
