2. The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial No. 868/2023 arising out of Chutiya P.S. Case No. 16/2021 dated 18.03.2021 registered for the offence punishable u/s 306 read with Section 34 of the Indian Penal Code.

As per the prosecution case, the informant has alleged that the petitioner and the co-accused persons came to the house of the informant and said that they would not spare the husband of the informant, as he had caught hand of Lakhiya Devi he would not be permitted to live. It is further stated that as a result of the said incidence on 15.03.2021, on 18.03.2021, the

Patna High Court CR. MISC. No.55519 of 2024(2) dt.28-03-2025 2/3 husband of the informant committed suicide by consuming poison. The informant has alleged that the cause of suicide is the threats given by the petitioner and the co-accused persons.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The other co-accused person has already been granted bail by the Co-ordinate Bench vide order dated 26.04.2022 passed in Cr. Misc. No. 66784/2021. There is a delay of 2 days in lodging the F.I.R. There is no specific allegation against the petitioner. The petitioner has five antecedents and he is on bail in all the aforesaid cases as stated in para 3 of the bail petition. The petitioner is in custody since 09.10.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Rohtas at Sasaram in connection with Sessions Trial No. 868/2023 arising out of Chutiya P.S. Case No. 16/2021, with the condition ;-

The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
