The petitioner is languishing in custody since 16.02.2016 in connection with Aurai P.S. Case No. 97 of 2015 for the offences instituted under Sections 395 and 412 of the IPC. It is alleged that on 09.06.2015 at 2.30 P.M. the vehicle and some articles of the informant have been looted by some miscreants when he alongwith his family members were returning from Varanashi after performing Mundan of his son. It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.02.2016 and the charge sheet has been submitted in the present case. There is no allegation of
Patna High Court Cr.Misc. No.25619 of 2016 (3) dt.11-08-2016 2/2 tampering of the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. No T.I. Parade has been conducted. There is no recovery of any incriminating article from possession of the petitioner.
On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur, in connection with Aurai P.S.
