The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 323, 307, 353, 337, 504, 506, 379/34 of the Indian Penal Code.

It is case of assaulting and creating hindrance to the police personnel in discharging the official duty by the petitioner along with other accused person.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in the present case due to land dispute. General and omnibus allegations have been levelled against the petitioner. It is further submitted in para 7 of

Patna High Court CR. MISC. No.54071 of 2023(2) dt.25-08-2023 2/2 the petition that this case has been lodged by the informant to harass the petitioner and his family as a matter of fact several civil cases are pending between informant and petitioner for last about 20 years. The petitioner is languishing in judicial custody since 06.06.2023.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Patori P.S. Case No. 233 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned J.M. 1st Class, Samastipur.
