The petitioner seeks bail in a case registered for the offences under Sections 394, 428 of the Indian Penal Code. The learned counsel for the petitioner submits the petitioner is in custody since 16.03.2021, charge-sheet has been submitted and has antecedent of two cases and the informant alleges that he was intercepted by four accused persons who looted his pick up van along with Rs. 14,000/- and mobile. The learned counsel for the petitioner submits that FIR was instituted against unknown and the petitioner was arrested based on suspicion since he had antecedent. It is further submitted that that the petitioner had not been put on T.I. Parade and nor any incriminating article has been recovered

Patna High Court CR. MISC. No.63206 of 2021(2) dt.29-03-2022 2/2 from his possession and co-accused Ram Khela Rai has been granted bail by order dated 10.03.2022 passed in Cr. Misc. No. 60400 of 2021 and Sandeep Kumar, Pakash Kumar and Devevedra Yadav had been granted bail by order dated 23.02.2022 passed in Cr. Misc. No.56449 of 2021. The learned APP vehemently opposes the bail application.

Considering the fact the petitioner is in custody since 16.03.2021, chargesheet has been submitted and co-accused have been granted bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Jogapatti P.S. Case No. 505 of 2020 with a condition that one of the bailor shall be the father of the petitioner (Ved Prakash). The application stands allowed.
