The petitioner has filed the instant application for grant of regular bail in connection with Kankarbagh P.S. Case no. 315 of 2020 registered under sections 414, 454, 380, 511 and 34 of the Indian Penal Code and sections 25(1-B)(a) and 26 of the Arms Act.
As per allegation in the FIR, on being confronted by the police personnel, it is stated that the three accused persons managed to escape. However, from a bag hanging on the scotty a country-made revolver with six cartridges loaded, besides other articles as mentioned in the FIR were recovered. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No
Patna High Court CR. MISC. No.10127 of 2021(2) dt.15-06-2021 2/2 incriminating article has been recovered from his conscious possession. Referring to the supplementary affidavit it is submitted that co-accused, owner of the scooty namely Md. Sonu has been enlarged on anticipatory bail vide order dated 15.1.2021 passed in Cr. Misc. no. 28759 of 2020. The petitioner is in custody since 16.9.2020 and investigation in the case has concluded.
The application for bail is opposed by learned Additional Public Prosecutor for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case together with grant of bail to co-accused and the petitioner having remained in custody for over 8 months, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Kankarbagh P.S. Case no. 315 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Patna.
