====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 27-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sikandra P.S. Case No. 152 of 2018 instituted for the offence under Sections 147, 148, 149, 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged in the written report that on order of this petitioner, co-accused Binod Mahto fired upon Balmiki Yadav from pistol which hit on his right Kanpatti. Co-accused Awdhesh Yadav is alleged to have fired in Panjara of Dharmendra Yadav, on account of which, he died. Counsel for the petitioner submits that petitioner is merely order giver.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

Patna High Court Cr.Misc. No.69372 of 2018(2) dt.27-11-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamui, in connection with Sikandra P.S. Case No. 152 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
