2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Pusa P.S. Case No. 68 of 2023 registered for the offence punishable under Sections 302 and 120(B)/34 of the Indian Penal Code.

3. Earlier the bail application of the petitioner has been rejected vide order dated 29.11.2023 passed in Cr. Misc. No. 74168 of 2023.

4. As per the prosecution case, the petitioner is said to have assaulted the deceased.

5. Learned counsel for the petitioner submits that the petitioner is HIV positive, therefore, his prayer for bail may be considered on humanitarian ground.

6. I have considered the submissions of the parties.

7. From the document on record, it appears that the petitioner is HIV positive.

8. In view of the above, this application is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-VII, Samastipur/ concerned Court in connection with Pusa P.S. Case No. 68 of 2023.
