JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-04-2016 The petitioner being husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 323, 379, 406, 504, 34 of the Indian Penal Code.
The basic accusation is of torture for nonfulfilment of dowry demand. The marriage between the petitioner and the informant are admitted.
It is submitted by learned counsel for the petitioner that petitioner admits his marriage with the informant but he is not ready to keep the informant due to the past conduct of the informant. Both tried to resolve the issue in terms of permanent alimony but the same could not be resolved.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.33602 of 2015 (7) dt.19-04-2016 2/2 informant that informant is ready to reside with the petitioner but the petitioner, for no reason is adamant not to keep the informant.
In the circumstance, the reconciliation, at present does not appear to be feasible.
Let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Arer P.S. Case No. 89 of 2014, G.R. No. 2142 of 2014, pending in the court of learned Additional Chief Judicial Magistrate, Madhubani. With the observations above, the application stands disposed of.
