Petitioner apprehends his arrest in connection with a case registered under sections 406, 408, 409, 420, 467, 468, 471 and 120B/34 of the Indian Penal Code.
The present case was lodged by bank manager against several persons including the petitioner on the ground that they, having played fraud, got sanctioned loan from the bank placing indemnity bond but submission on behalf of the petitioner is that the petitioner had not taken gold loan which is evident from perusal of annexure 3 to the petition and moreover, the petitioner had already cleared his dues which is evident from perusal of annexure 6 to the petition. Patna High Court Cr.Misc. No.27644 of 2016 (5) dt.25-01-2017 did not controvert the aforesaid submissions. Accordingly, this anticipatory bail is allowed and it is ordered that, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Miss. Supriya Gosawmi, Judicial Magistrate, Ist Class, Patna/ concerned court in Gandhi Maidan P.S. Case no. 155/2013 subject to condition as laid down under section 438(2) of the Cr.P.C.
