Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 341, 323, 324, 307,k 379, 354, 504 and 506/34 of the Indian Penal Code, registered in connection with Maharajganj P.S.Case No. 09 of 2022. As per allegation, the named accused persons, including the petitioner, came to the house of the informant equipped with farsa, sword and hockey sticks. They started assaulting the brother of the informant with farsa on his head. The learned counsel for the petitioner has submitted that there was scuffle between the two groups relating to some dispute over a cricket match. There is case and counter case. Patna High Court CR. MISC. No.53953 of 2022(2) dt.31-01-2023 2/2 head is not on the petitioner, rather it is against co-accused Mantu Yadav. The only allegation against the petitioner is that he snatched the clothes of the wife of the informant. The petitioner is a person of clean antecedent.

There is case and counter case and the petitioner is a person of clean antecedent.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Maharajganj P.S.Case No. 09 of 2022, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
