Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Dhaka P.S. Case No. 101 of 2022, registered for the offences punishable under Sections 147, 148, 149, 448, 380, 353, 427, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
The learned counsel for the petitioner has submitted that the FIR shows itself that it was scuffle between two rival groups at the occasion of Panchayat election. Though there was
Patna High Court CR. MISC. No.53709 of 2022(2) dt.31-01-2023 2/2 allegation of firing, but none has suffered injury and the case has been compromised. The petitioner is a person of clean antecedent.
Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran, Motihari in connection with Dhaka P.S. Case No. 101 of 2022, subject to condition as laid down under section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
