The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 406/420/500/120B of the Indian Penal Code.

The prosecution case is that the informant fixed marriage of his daughter with petitioner no.3, the son of petitioner no.1 and, subsequently, the marriage was not performed. It is submitted by learned counsel for the petitioners that the marriage could not be performed as elder son of petitioner nos.1 and 2 died and subsequently, the informant has retracted from initial version and has filed a petition to that effect

Patna High Court Cr.Misc. No.35660 of 2015 (2) dt.21-08-2015 2/2 before the learned court below, the same has been brought on record as annexure-2 to the petition.

Considering the retracted version of the informant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari in connection with Darpa P.S. Case No.9 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
