JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,325,307 and 504/34 of the Indian Penal Code, section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act and section 27 of the Arms Act.
It is alleged that the petitioner resorted to firing causing injury to Ram Surat Ram.
It is submitted by the learned counsel for the petitioner that in the background of serious land dispute pending between the parties, the accusation has been levelled. The injury of Ram Surat Ram has been found to be simple caused by hard and blunt substance. It is further submitted that there is counter version of
Patna High Court Cr.Misc. No.34488 of 2015 (2) dt.17-08-2015 2/2 the occurrence where the petitioner side has received grievous injury.
Considering the fact that the accusation has been levelled in the background of serious land dispute, the accusation is not being corroborated by medical opinion and the petitioner side has received grievous injury, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Siwan Mufassil P.S. Case No.106 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
