JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-10-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 307/302/120B and other allied sections of the Indian Penal Code.

Petitioner and other accused persons are alleged to have assaulted informant's husband and father-in-law by means of knife and iron rod. Her father-in-law died during treatment. Learned counsel appearing for the petitioner submits that the petitioner is innocent and have falsely been implicated in this case. He submits that at best petitioner can be said to be an order giver and there is no allegation of committing overt act against him.

Considering the nature of allegation against the petitioner, in the event of arrest/surrender within six weeks from

No.63268 of 2021(3) dt.17-10-2022 2/2 today, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in Rajepur Police Station Case No. 51 of 2021, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
