The petitioner seeks bail in connection with Bhagwanpur P.S. Case No.199 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The informant lodged information regarding involvement of the petitioner and other accused persons in transporting of illegal liquor from one place to another and also got information that liquor was being unloaded from truck to van.

Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot and nothing has been recovered from the conscious possession of the petitioner. The petitioner is not either the owner of the truck nor the van. Save

No.72164 of 2018(2) dt.10-12-2018 2/2 and except suspicion of the police that petitioner is involved in the transportation of illegal work, there is no material to show the involvement of the petitioner in the present case. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge (Excise), Begusarai in connection with Bhagwanpur P.S.
