The petitioner has preferred this application for grant of regular bail in a case registered under sections 25(1-B)(a) and 26 of the Arms Act.

As per the prosecution case, a loaded country made pistol and a stolen motorcycle was recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the possession of the petitioner who has been falsely implicated in the case because of his antecedents. He is in custody since 20.6.2021 and chargesheet has been submitted in the case. It is

No.63014 of 2021(2) dt.15-04-2022 2/2 further submitted by learned counsel for the petitioner that a typographical error has occurred in prayer portion of the bail petition wherein the F.I.R. number has been wrongly typed as Birpur P.S. Case no.43 of 2020 instead of the correct Birpur P.S.Case no.120 of 2020.

Having heard learned counsel for the parties and taking into consideration the facts of the case including the petitioner having remained in custody for more than 9 months, the Court directs the petitioner to be enlarged on bail in connection with Birpur P.S. Case no.120 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Birpur, Supaul.
