1. Heard learned counsel for the Petitioner and learned APP for the State

2. Petitioner apprehends his arrest in connection with Hasanpur P.S. Case No. 238 of 2022 dated 03.10.2022 registered for the offences punishable under Sections 25(1-B)A, 26 and 35 of the Arms Act.

3. The main submissions advanced by petitioner's counsel are that the petitioner was not apprehended at the alleged spot and his name was disclosed by apprehended coaccused namely, Lav Kumar @ Karu Kumar from whose possession one loaded country-made pistol with one live bullet and one misfired bullet was recovered but except the said disclosure made by the apprehended co-accused there is no material against this petitioner and till date during investigation

Patna High Court CR. MISC. No.55624 of 2023(2) dt.13-09-2023 2/2 no independent witness has supported petitioner's involvement in the alleged crime and he is a young person having fair and clean antecedent and he has been dragged in this case mainly on account of disclosure made by the co-accused.

4. Learned APP appearing for the State has opposed the prayer for bail.

5. Considering the above submissions as well as petitioner's young age and his fair and clean antecedent, this Court is inclined to accept the prayer for anticipatory bail of the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Hasanpur P.S. Case No. 238 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
