18-08-2015 Heard learned counsel for the petitioner and learned A.C. to Standing Counsel - 28.
The petitioner in the present writ petition has made a very limited prayer for a direction to the appellate authority i.e. respondent no. 3 to dispose of Forest Appeal No. 74 of 2014. It was submitted by learned counsel for the petitioner that his vehicle i.e. truck, bearing registration no. UP 65R/9543 was seized on an allegation of violation of Forest Act. Subsequently, confiscation proceeding was initiated and the seized vehicle was confiscated, against which, the petitioner had preferred an appeal in the year 2014, however; the same has not
Patna High Court CWJC No.10810 of 2015 (2) dt.18-08-2015 2/2 been disposed of.
Keeping in view the fact that the confiscated article is a vehicle, the Court is of the opinion that writ petition can be disposed of with an observation that learned appellate authority i.e. respondent no. 3/Collector, Rohtas may take appropriate step so that the appeal i.e. Forest Appeal No. 74 of 2014 may finally be disposed of preferably within a period of four months from the date of receipt/production of a copy of this order.
