Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 308/34 of the Indian Penal Code and 47A of the Excise Act.

It is alleged that 60 liters of country made liquor and raw materials were recovered from the bamboo orchard of the petitioner. On chase, one Lal Paswan was apprehended, who suggests the name of the petitioner.

It is submitted by the learned counsel for the petitioner that recovery cannot be treated from the possession of the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.34867 of 2015 (2) dt.01-09-2015 The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Majhauliya P.S. Case No. 283 of 2015, pending in the court of learned Chief Judicial Magistrate, Bettiah, West Champaran. With this observation this application is disposed of.
