The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376/511 of the Indian Penal Code and 3(x) of the S.C./S.T.(Prevention of Atrocities) Act.

It is alleged that the informant went to the shop of one Manoj Rai to purchase some articles then Manoj Rai wanted to outrage her modesty. When sister of the informant came there then the informant conveyed to her sister and told about the occurrence. Her sister informed about the occurrence to her father, who came at the shop of Manoj Rai, then accused persons including the petitioner abused him by calling caste name. Manoj Rai also set his shop on fire and assaulted his father. Counter

Patna High Court Cr.Misc. No.35269 of 2015 (2) dt.20-08-2015 version of the occurrence was also recorded by co-accused Manoj Rai being Nokha P.S. Case No. 88 of 2015. It is submitted by the learned counsel for the petitioner that accusation against the petitioner is omnibus and general, whereas thrust of accusation is against coaccused Manoj Rai. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Considering the thrust of accusation is against Manoj Rai, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Rohtas (Sasaram) in connection with Nokha (Dharampura) P.S. Case No. 89 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
