Mr. Smt. Reena Sinha ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 03-12-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Rajgir P.S. Case No. 215/2018, instituted under Sections 414/34 of the Indian Penal Code.

It is alleged in the written report that during vehicle checking, the police stopped two motorcycles but the persons sitting on aforesaid motorcycle started running away. Out of them two persons were apprehended. They disclosed their name as Kalu Paswan and the petitioner. On search, a black bag containing 37,000/- cash, two screw drivers, three mobiles and one Honda motorcycle were recovered.

Learned counsel for the petitioner has submitted that petitioner has clean antecedent. He has been arrested merely on

Patna High Court Cr.Misc. No.70315 of 2018(2) dt.03-12-2018 2/2 suspicion. It is further submitted that aforesaid motorcycle belongs to Jeetu Yadav. No any complaint has been filed by anybody about theft of aforesaid motorcycle.

Petitioner has clean antecedent. He is in custody since 28.07.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 215/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
