Petitioner seeks bail in a case registered for the offences punishable under Sections 376,342,323,504 and 506 of the IPC.

According to FIR, the petitioner was in physical relation with the informant, a girl aged about 18 years, by pretending that the petitioner would marry with her. When the informant pressurized for marriage, the petitioner allegedly took her to Bettiah alongwith her Adhar Card for court marriage but the petitioner fled away keeping her in a house. Evidently, the intention of the petitioner was from very beginning dishonest and fraudulent one in obtaining consent of the victim. The victim cannot be disbelieved only for the reason that she did not make any complaint to the police at Bettiah nor she showed the place where she was kept by the

Patna High Court CR. MISC. No.10162 of 2021(3) dt.13-08-2021 2/2 petitioner at Bettiah. Petitioner is in custody since 07.09.2020. Considering the facts of this case aforesaid, I am not inclined to enlarge the petitioner on bail in connection with Chanpatia P.S.Case No.91 of 2020 pending in the court of learned S.D.J.M., Bettiah, West Champaran. Hence, prayer is refused.
