JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-08-2017 This application under Section 482 of the Code of Criminal Procedure has been filed by the petitioners for quashing the order dated 23.08.2016 passed by the learned 1st Additional District and Sessions Judge-cum-Special Judge, Scheduled Castes and Scheduled Tribes, Purnea in Special (SC/ST) P.S. Case No.50 of 2016 arising out of SC/ST P.S. Case No. 64 of 2015 by which cognizance has been taken against the petitioners inter alia under Section 3 (1)(x) (xi) of the Schedule Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

In view of the provision prescribed under Section

Patna High Court Cr.Misc. No.42687 of 2016 (2) dt.28-08-2017 14A of the Schedule Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015, learned counsel for the petitioners seeks leave to withdraw the present application in order to file an appropriate appeal before this Court in the same subject matter.

Leave is granted.
