Petitioners, who are in custody, seek bail in connection with Dhamdaha P.S. Case No. 19 of 2018 registered for the offences punishable under Sections 341, 342, 323, 324, 307, 506, 34 of the Indian Penal Code.

Informant has alleged that when he was returning with all family members F.I.R. named accused who belong to same family started assaulting them.

It has been submitted that petitioners are innocent and have been falsely implicated in this case. There is specific allegation against Ramesh Mehta of assaulting by Kudal on brother of informant. There is no specific allegation against

Patna High Court Cr.Misc. No.69885 of 2018(2) dt.07-12-2018 2/2 petitioners of committing any overt act. Allegations are general and omnibus in nature. Petitioners have no criminal antecedent and are in custody since 09.09.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea, in connection with Dhamdaha P.S. Case No. 19 of 2018.
