2. This criminal appeal has been filed against the order dated 08.07.2024 passed by learned Additional Sessions Judge-VIII-cum-Exclusive Special Judge SC/ST Act, Nawada in connection with ABP No. 1702 of 2024 arising out of Nardiganj P.S. Case No. 112 of 2024, registered under Sections 341, 342, 323, 307, 376, 511/34 of the Indian Penal Code and Section 3 (i) (s), 3(2)(v), 3(1)(w)(i), 3(1)(r) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, whereby the prayer for anticipatory bail of appellant has been rejected.
3. As per prosecution case, this appellant along with
Patna High Court CR. APP (SJ) No.3585 of 2024(3) dt.10-09-2024 2/2 one unknown accused assaulted daughter of informant and attempted to commit rape with her. The victim in her statement recorded under Section 164 Cr.P.C. has supported the prosecution case.
4. Considering the gravity of accusation and statement of the victim recorded under Section 164 Cr.P.C., I do not find any ground to interfere with the order of the learned court below and as such, the appeal, which has been filed for grant of anticipatory bail, is hereby rejected.
