The appellant seeks pre arrest bail in connection with Ballia P.S.Case No.65 of 2016 registered for offences punishable under Sections 147, 148, 149, 341, 342, 302 of the Indian Penal Code, Section 27 of the Arms Act and Section 3(ii)(iv) of SC/ST (Prevention of Atrocities) Act.
It appears that status report in this case was called for as there was direction of this Court to expedite the trial. From the status report, it appears that now all the witnesses have been examined in this case.
Submissions of the learned counsel for the appellant is that no evidence has come against the appellant and argument has also been concluded but the case is pending for argument of
Patna High Court CR. APP (SJ) No.1281 of 2016 (13) dt.13-11-2017 2/2 the another accused person and appellant is in custody for more than 18 months.
Heard learned Special P.P. also.
Having considered both sides and in view of the submission, the learned Special Judge is directed to expedite the same and conclude it within a period of three months positively and once the judgment has been delivered, he shall inform this Court about the same. The learned Special Judge has to comply the aforesaid direction of this Court strictly in sense. No any adjournment shall be granted either to the prosecution or to the appellant.
