Heard the learned counsel for the petitioner. This civil miscellaneous application has been filed with a prayer for early disposal of Matrimonial Case No. 103 of 2017.

The learned counsel for the petitioner has submitted that the above mentioned matrimonial case has been filed by the petitioner, who is the husband of the respondent Meetu Kumari @ Mitu Kumari, for restitution of conjugal rights under Section 9 of the Hindu Marriage Act, 1955. The suit was filed on 31.10.2017 and the respondent has filed her written statement

Patna High Court C.Misc. No.445 of 2021(2) dt.23-12-2021 2/2 on 20.09.2018, but there is no progress in that suit. Considering the submission of the learned counsel for the petitioner, the learned Principal Judge, Family Court, Lakhisarai, is directed to take every endeavour for expeditious disposal of Matrimonial Case No. 103 of 2017, subject to legal or procedural impediment, if any.

With this observation, this application is disposed of. Office shall ensure that all the defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
