JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-08-2024 The present writ petition has been filed seeking the following relief:- "1. That this writ application is being filed for a direction to the concerned respondents to remove the encroachment from the public way, appertaining to Khata No. 1520, Khesara No. 4540, since the private respondents, in connivance with the concerned respondent, has constructed house on the said public way under the P.M.A.Y.-HFA scheme."

After some arguments, the learned counsel for the

Patna High Court CWJC No.15174 of 2023(2) dt.07-08-2024 2/2 petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the Respondent No. 6 i.e. the Executive Officer, Nagar Parishad Benipur, Darbhanga, for redressal of his aforesaid grievances. Liberty, so sought, is granted.
