The petitioner seeks regular bail in Maniyari P.S. Case No. 246/2018, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 353, 332, 427, 504 and 506 of the Indian Penal Code and sections 30(a), 38 and 41 of Bihar Prohibition & Excise Act.

In the written report, it is alleged that huge quantity of illicit foreign liquour has been recovered from Baithka of Baliram Singh.

Learned counsel for the petitioner has submitted that petitioner has falsely been implicated in this case. He is neither apprehended on the spot nor any incriminating article has been recovered from his possession. His name has come in this case

Patna High Court Cr.Misc. No.73255 of 2018(2) dt.10-12-2018 2/2 on the confessional statement of co-accused Kameshwar Singh. Petitioner is in custody since 18.09.2018 having clean antecedent.

Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur in connection with Maniyari P.S. Case No. 246/2018.
