JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-12-2015 Petitioner being husband of the complainant is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. The petitioner along with his lawyer is present.

However, none is appearing on behalf of complainant/O.P. No. 2, though ordinary process of notice has been served to the complainant through her lawyer appearing before learned Court below as gets reflected from the office note dated 04.12.2015.

It is submitted by learned counsel for the petitioner that both sides have decided to part ways and a joint

Patna High Court Cr.Misc. No.35029 of 2015 (3) dt.07-12-2015 2/2 application to that effect has been filed before learned Court below.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for three months on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Vaishali at Hajipur in connection with Trial No. 3394 of 2014, arising out of Complaint Case No. 2606 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The provisional bail of the petitioner will be confirmed by learned Court below after verifying the fact that joint compromise petition has been filed by the parties before learned Court below.
