====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-12-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in connection with Sultanganj P.S. Case No.90 of 2018 registered under Sections 392 and 411 of the Indian Penal Code.
The accusation is that in course of going to school, two persons, who were coming behind the informant on Scooty, snatched the mobile of the informant. On chase by the public, one person was apprehended, who disclosed his name as Monu Kumar, and from his possession, the snatched mobile of the informant was recovered. The aforesaid apprehended coaccused Monu Kumar also disclosed the name of the petitioner as his associate.
Patna High Court Cr.Misc. No.71221 of 2018(2) dt.04-12-2018 2/2 Learned counsel appearing on behalf of the petitioner submits that the petitioner was not apprehended on the spot. While the petitioner is accused in one case, as detailed in paragraph-3 to this application, but in that case he is on bail. In the present case, the petitioner is in custody since 15.07.2018. Further submission is that the apprehended co-accused Monu Kumar has already been granted bail by a Coordinate Bench of this Court vide order dated 05.09.2018 passed in Criminal Misc. No.45461 of 2018.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Patna City, Patna, in connection with Sultanganj P.S. Case No.90 of 2018. Out of the two sureties, one must be either parents or close relative of the petitioner.
