====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 21-08-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is languishing in custody since 07.03.2019 in a case for the offence registered under Sections 406, 409 and 420 of the IPC.
The prosecution story, in brief, is that the petitioner being the Headmaster of Primary School, Kararahi, BlockMarauna, was allotted to Rs. 11,88,900/- through Cheque No. 3053 in the School A/C No. 30537363278, State Bank of India, Nirmali, for construction of school building for the financial year 2012-13. He withdrawn the aforesaid amount but work for school building was not started and misappropriated of Rs.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. It is alleged that the petitioner, being the Headmaster of the school, defalcated the amount of Rs. 11,88,900/- which was made available in the school account in respect of construction of the school building. It is submitted that the petitioner has already paid a sum of Rs. 7,75,000/- through different cheques to the building contractor. It is further submitted that the petitioner is ready to deposit an amount of Rs.
1,00,000/-(Rupees One Lac) only in the learned court below which shall be subject to final disposal of the case. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, the petitioner is directed to deposit an amount of Rs. 1,00,000/- (Rupees One Lac) only in the learned court below which shall be subject to final disposal of the case.
Patna High Court CR. MISC. No.51524 of 2019(2) dt.21-08-2019 3/3 bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class at Supaul, in connection with Marauna P.S. Case No. 97 of 2018.
