Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Moro P.S. Case No. 13 of 2022, lodged under Sections 420, 467, 468, 471, 34 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2016. As per prosecution case, the total recovery of 3585.280 liters of foreign liquor is the subject matter of this case.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that name of petitioner has figured in this case by the

Patna High Court CR. MISC. No.53798 of 2022(2) dt.01-11-2022 2/2 secret information received by the Police. He also submits that the said recovery, from the seizure memo, has been made from a place which is situated in front of the milk dairy of petitioner. Learned counsel for the petitioner further submits that petitioner is a man of clean antecedent and he is in custody since 29.07.2022.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Darbhanga in connection with Moro P.S. Case No. 13 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
