The petitioner seeks regular bail in Haspura P.S. Case No. 36/2018, registered for the offences punishable under Sections 302, 498A and 120B of the Indian Penal Code and section 27 of the Arms Act.

Learned counsel for the petitioner has submitted that petitioner is Mausera brother of the husband of the deceased. In the written report there is general and omnibus allegation against the petitioner. Informant alleged that on getting information of death of his niece he went to the place of occurrence and found his son-in-law Rahul Sharma also sustained injury. It appears that his son-in-law after committing murder of his niece has just made injury in conspiracy to save

Patna High Court Cr.Misc. No.74350 of 2018(2) dt.12-12-2018 2/2 himself. In such manner, in the entire written report there is no specific allegation of overt act against this petitioner. Other coaccused has been allowed bail. Petitioner is in custody since 28.08.2018 having clean antecedent.

Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Daudnagar, Aurangabad in connection with Haspura P.S.
