The petitioner seeks bail in Warisaliganj P. S. Case No.202 of 2019 instituted for the offence under Section(s) 366A/34 of the Indian Penal Code.

In the written report it is alleged that son of informant got message from Dilkhush Kumar on his mobile that his sister has been kidnapped. Dilkhush Kumar informed that his sister has been kidnapped by Suraj Kumar and his brother, namely, Pukal Kumar.

Learned counsel for petitioner submits that date of occurrence is in the night of 23/24.6.2019 and FIR has been registered on the same day and the victim girl herself appeared

Patna High Court CR. MISC. No.50242 of 2019(2) dt.17-08-2019 2/2 along with the accused person at the police station on the next day. The victim has given her statement U/s 164 Cr.P.C. which is annexed as Anexure-2 to bail petition, wherein she has levelled general and omnibus allegation against this petitioner that petitioner with other accused persons took her forcibly to Patna on bike. Learned counsel for petitioner further submits that compromise petition has also been filed in the Court below which is annexed as Annxure-3 to bail petition. Petitioner is in custody since 27.6.2019 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM- Ist, Nawada in connection with , Warisaliganj P. S. Case No.202 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
